Robert Collins, Jr., President SUBJECT: NYMEX ACCESS and C-21 Frame Relays Thank you for your patience and understanding concerning the frame relay equipment issue. I'm pleased to inform you that the Exchange has made a final decision on the disposition of this equipment. Please be advised that AT&T will be contacting you shortly to arrange for disconnection and removal of the router and modem only for those NYMEX ACCESS and C-21 users connecting to our systems via frame relay. This is AT&T's equipment and they will arrange for its pickup. Users are responsible for the costs associated with any AT&T equipment that might be damaged or lost. All NYMEX ACCESS terminal holders must contact their telephone carrier to arrange for the discontinuance of phone service to their terminal. Since the user set up the account with AT&T, they are responsible for contacting the carrier and making arrangements for this service to be discontinued. The Exchange will not do this. This should be completed as quickly as possible since the Exchange will not pay for any reimbursement costs incurred after December 31, 2001. Finally, with reference to the NYMEX ACCESS and C-21 terminal equipment itself, the Exchange requires that NYMEX ACCESS and C-21 frame relay holders write or email the NYMEX Customer Service Call Center (NCSCC) with their intention to return the equipment to the Exchange at their own cost, or to keep the equipment and continue using it for NYMEX ACCESS and / or C-21 usage. Any use of these software programs after that date or any copying or re-distribution of these programs is strictly prohibited. To continue using the equipment, you must format the hard drive and install any operating system that supports Internet Explorer 5.1 or greater.
