U.S. Army Corps of Engineers (No. 99-1178 (U.S. January 9, 2001)). By a vote of 5 to 4, the Court determined that "isolated" waters (often wetlands) are not subject to regulation under the Clean Water Act (and the Section 404 permitting program). This decision has significant implications for anyone who is, or will be engaging in the construction of generating facilities, transmission lines, factories, houses, pipelines, or similar projects.
